We called to report that someone invaded our home, there was nothing missing but a gas stove burner was turned on full, gas only, the another burner was turned on full and lit with flame. The kitchen is filling with explosive gas while an open flame is burning. The situation was discovered after a visiting relative returned to the house that early evening.
This invasion occurred while Walter was at the courthouse for the “emergency” injunction hearing. Mary Jo was sitting in her truck at the area of dispute to insure that nothing would happen while Walter was at the hearing. At the exact time (3:30 pm) of the start of the hearing, Mary Jo witnessed Robin Whitley (a local surveyor) drive up, get out of his truck, and begin to remove existing monumentation in the area. She got out of her truck and stood where she could clearly be seen, which prompted Mr. Whitley to get back in his truck and drive away.
On August 7th, 2005, Mary Jo goes to the area of dispute in an attempt to stop the bulldozers from destroying our property. A sheriff's deputy is called out and Mary Jo is told to leave the area. She protests, stating that she is not named in the injunction and has the right to remain.
“You are restrained too because you are with Walter and if you don't leave, I will take you on a ride to jail.”, the female Officer said. Mary Jo weighed the options and decided not to worry her youngest daughter and grand daughter also in the area. She goes to our home to “move out” of the area covered by the restraining order.
While Walter is in Atlanta, Mary Jo leaves a message in Jack Rhodes’ voice mail. Generally saying, “Walter is out of town, she is currently without legal representation, and is in a position to speak directly with Jay, if he is interested”.
Jay calls back and leaves a message in Mary Jo’s voice mail, i.e. his cell phone number.
Mary Jo calls back and leaves a message in Jay’s cell voice mail stating that she would be at a different number and to call her there. She warns Jay that it would show as Walter’s number on a caller ID, but that he’s out of town and she is caring for his elderly mother while he is away and it’s really mom’s house.
At about 6:00 p.m. Jay calls Mary Jo at the home of Walter’s mother. He states that he is taking off in his private airplane. Mary Jo asks about his two little boys, mentions her two little girls, and talks about why Walter is in Atlanta, i.e. business. She discusses caring for his elderly mom that suffers from NPH and her recent decline of health. The goal was to put human faces involved with the situation at hand
Mary Jo then suggests a potential solution to the problem with the land. She proposes that for every foot of our land that he needs for his road, (maybe a half acre or so) he trade for equal land footage in his commercial zone. An alternative could possibly be a couple residential lots.
Jay tells Mary Jo it’s too late to discuss this.
Mary Jo tells Jay that she holds the majority interest in the 82’ x 660’ strip of land, and that this was where she intended to build her Art Glass business structure, a concrete dome with a mosaic exterior. She mentions taking a class at the Monolithic Dome Institute in preparation for building her dream. Mary Jo tells Jay he’s going after the “Wrong Man” on this issue, and that she’s the one he should sue.
Jay’s response was the following: “Lady, there’s nothing to talk about here. Here’s what’s gonna happen. I’m going to have my road, I’m going to have your house, you and your family aren’t going to have a place to live, and I’ll do it by whatever means necessary.”
Mary Jo’s response is:"Yeah Jay, like sending some goon into our house to turn the gas on, while Walter is sitting in front of a judge at your injunction hearing."
Jay says “I don’t have to listen to this sh…click, and the phone call is over.
Mary Jo files for the bankruptcy of Rainbow Glassworks in October 2005, after we were instructed by a Deputy Sheriff that the whole family was to stay off the property and our Attorney told us there was nothing he could do.
