The South 1/2 of Section 22 east of Four Mile Creek – Gov. Lots 5 & 6
The area has grown by 27.22 acres and moved north by at least 440 feet
On Nov. 2.1854, patent #26030 was issued by the BLM via a military warrant recorded in Vol. 82 pg. 140 to Iona Griffin and passed to Henry Yonge for 159 75/100th acres identified as Government Lot 6 in Sec. 22T l S R l9 W. On May 1,1855, patent #11599 was issued by the BLM to Henry Yonge for 53 acres identified at Government Lot 5 in Sec. 22T l S R l9 W. The total acreage for Gov. lots 5 and 6 totaled 212 and 75/100th . The profile of the terrain and shoreline are shown on the BLM plat of T1S R19W for the bottom of Sec. 22 Government lots 5 and 6. The field measurement recorded by the BLM for the south line of Sec.22 is 32.l0 chains, or 2112.66 feet. The BLM normally monumented all 1 mile corners and ½ mile points within the TRS grids surveyed. The BLM did not place a ½ mile post on the south line of Sec.22 because the post would have been located at the water's edge or in the water, and is evidenced on the BLM plat of T1S R19W. The line dividing the SE ¼ from the SW ¼ in Sec. 22 ended at thewaterline, and a ½ mile post was not placed along the south line of Sec. 22.
On July 6th, 1885, a tax deed (1) was sold by Walton County to Michael King for unpaid taxes on the SE ¼ of Sec. 22 and the E ½ of the SW ¼ of Sec. 22 TIS Rl9W. The total acreage identified on the deed is for 240 acres. No reference to the two original descriptions from the BLM patents is given on the tax deed. The land mass identified on the tax deed as 240 acres does not match the BLM's total of 212 &75/100th . The differences between the tax deed compared to the BLM plat & patents indicate that the north line of the SE and SW quarter sections would be relocated either too far north at 240 acres. In tracing the chain of title forward from the tax deed sold by Walton County, the field measurement for the south line of Sec. 22 is currently identified as about 3388 feet long. This measurement does not match the BLM's original measurement of 2112.66, and reflects a difference of about 1275.34 feet. Subsequent land owners to the Tax Deed sold are using a ½ mile point on the south line of Sec.22 that is located over 440 feet north of the water's edge. If the BLM had placed a post, it would have been close to the proximity of the water’s edge, not 440 feet north. However, the BLM did not place a post. At this time, land originally identified by the BLM plat and patents issued located in Sec. 22, is currently shown as a portion of Sec. 27

This document seems to support the land identified in Section 27 as actually being a part of Section 22 and the landowners attempt to reconcile existing issues from the original tax deed issued on the land by the county. The reference on this deed to a location at Ramsey Branch seems to point to the location of BLM monumentation at the water’s edge. The monumentation would confirm the true north line of Section 27 and south line of Section 22. If this is the case, the monumentation would be the western most BLM stake on the dividing line between the sections. The true BLM corner would be 2112.66 feet east of the water’s edge. The BLM references a 6 deg 10 min southeasterly bearing in the field notes. The current line dividing the two sections is about 3388 feet long.
